Terms and Conditions
General provisions
These Terms and Conditions apply to all bookings for training that are made with PROACTIF via our website www.proactif.ch, by phone, or in person on our premises.
Content ownership
All the drawings, illustrations, icons, graphs, photographs, pictures, text, and all other elements on this website and in our training materials belong exclusively to PROACTIF. Consequently, the reproduction, publication, transmission, alteration, or distribution in any way or form whatsoever of the elements constituting this website or training materials is expressly prohibited. PROACTIF reserves the right to take legal action in the case of violations of these provisions.
Application of the Terms and Conditions of Registration
The Terms and Conditions of registration apply to all the types of training offered by PROACTIF as well as any training especially designed for a client after joint validation of the content, format, and proposed rates.
Terms of Purchase
The courses, training modules, and lectures presented in our range of activities are proprietary PROACTIF products. The following information is given for each element:
Reservation
Once made, a course reservation is final and assumes the client’s acceptance of these Terms and Conditions.
The reservation will be confirmed by PROACTIF as soon as the course is opened (minimum number of participants reached), along with the price of the training course, course content, number of lessons, and training venue and schedule.
Proactif reserves the right to cancel the course at any time, whether due to failure to reach a minimum number of participants or for any other reason reserved and decided by PROACTIF. In that case, the reservation will become null and void and the client will be released from their obligations. PROACTIF is under no obligation to give the reasons for the cancellation.
Course confirmation – payment request
As soon as the number of participants in the training session is reached, PROACTIF will confirm its opening. A confirmation/invoice will be sent to the client, either:
The client must make the payment within ten days of receipt of the confirmation/invoice.
Any payment delay will trigger a payment reminder sent by mail and PROACTIF reserves the right to invoice the costs of the reminder and interest for late payment.
Absences
In no event will absences be reimbursed or recovered. It is nevertheless possible for the client to have another person who meets the prerequisites of the course in question attend in her/his stead at no extra cost.
Course certificate
A course certificate may be provided, upon request, to any participant who has completed the training.
Intellectual property – Copyright
All of the materials provided by PROACTIF in the course of a training module are original works and, as such, are protected by intellectual property law and are copyrighted.
Consequently, the participant may not make use of, copy, or pass on all or part of these materials without PROACTIF’s prior written agreement.
Data protection
PROACTIF undertakes not to transfer to third parties the data of the participants in or contractor of the training of which it may be aware. The data will be used only to process reservations, facilitate navigation and payment of the courses, and provide information about new products, special offers, and various new developments linked to this site and/or PROACTIF in general.
The information that is provided will be stored on PROACTIF’s server under the SSL protocol and will be transmitted in encrypted form only so as to guarantee its confidentiality. The server recognizes the following automatically: IP address and website entry and exit dates and times.
The users of this website will be able to access, correct, and delete the information on the registration form as they wish, in writing, whether by means of an email or by regular mail to our headquarters.
We work with an internal control system (ICS) that meets the requirements of state institutions so as to prevent, avoid, and minimize errors.
Liability
PROACTIF shall bear no liability for any damage or injury sustained in any of the training that it provides, notably in the case of thefts or losses during the training.
Modification of the Terms and Conditions (T&C)
PROACTIF reserves the right to modify the T&C at any time. The client will be notified of the changes in the T&C and the date that they go into effect by email in good time. Should the modification create a major obstacle for the client, the client may cancel the contract before the date that the revised T&C go into effect. The right of cancellation is extinguished as soon as the revised T&C go into effect.
Legal jurisdiction
All contractual relations with the limited liability company PROACTIF OUVERTURES FORMATIONS Sàrl are subject to Swiss law. An amicable solution must be sought before launching any court action. Aigle is the place of jurisdiction.

- Price (all prices on our website are net prices in Swiss francs (CHF))

- by email, giving our bank account details
